Re: Back Child Support

My boyfriend owes 5,000 in back child support. He is making attempt each week to catch it up. Slowly but surely. He is now paying regular child support as well as his back.

They have taken his driver licence away from him because of this manner. My question is.. How can we go about getting his licence back?

Q: Restoration of license following suspension due to more than $5,000 in child support arrears

A: The restoration is entirely up to the Judge who suspended it. I would think you're going to have to satisfy him that either you've paid the arrears under $5,000 (thus making him ineligible for suspension)or that his license is so necessary for the production of his income that he would not be able to pay back the money without it.

This is an area unchallenged yet in Virginia law. There are plenty of opportunities to challenge it. However, that takes time and money for lawyers. Best bet is to pay the support down.

Of course, that answer is too obvious to be of much good to you.
