Legal Question in Family Law in Virginia

my brother is currently serving 12mons in chesterfield va for back child support, the judge said pay the 10,000.00 or do 12 mons. of course we nor he had the money so now he's doing time my question is how can we get some of that time reduced? he stopped paying because he was incarcerated at the time and when he came home to try and seek employment it was a difficult task due to his criminal record so he enrolled in school to get an associates degree to retrain himself and to earn a career it was the only way fesibile for him to obtain employment.

Your brother could write the judge a letter requesting a reconsidertion

and modification of his sentence for whatever mitigating circumstances

that might credibly support such a request (that haven't already been presented to the court for its consideration).
