Legal Question in Family Law in Virginia

I want to change my minor childrens names - 5 and 3 years old. Do I have to do it in the state we currently live in (Georgia) or can I submit the petition in Virginia, where the children were born? Also, their fathers location is unknown and has been for years. How difficult will that be since I have no way to find him to obtain his agreement?

You must do the petition for name change in the appropriate court in

Georgia where the children currently reside. (Where they were born is irrelevant.)

If you can demonstrate to the Georgia court that you've done your due diligence

with respect to locating the father but have been unable to do so, the

court will probably allow you to publish a notice of your petition for a name change in the local newspaper to satisfy the notice requirement to the father.
