I have three girls and two with my current husband and he is leaving us I want to know if I can leave the state with my children if there is not custody agreement in place

If there is no valid court order currently in place which would bear on this issue, the answer is, yes, you can head for other parts anytime you please, taking the children and without the permission of any other person or court, (which, of course, in no way implies that such a course of action would necessarily be a good idea).
