Legal Question in Family Law in Virginia

Child Custody and Leaving the Country

I have sole custody of my daughter, and no visitation to the father. He has filed for a motion of visitation. I am leaving the country to visit family in a few weeks. Am I obligated to tell him, and if so how far in advance should I tell him. He is very against me leaving, and I fear by telling him he will try and keep my daughter so we miss the flight.

Re: Child Custody and Leaving the Country

If your custody order has a requirement that you must give advance notice to the father under this kind of circumstance, then you must comply.

Otherwise, you can forget it.
