child custody and support

If the parents sign a contract between them regarding child support and custody, without going to court, would the contract be concidered legal and binding in a virginia court system?

Perhaps, perhaps not, depending upon all the various relevant factors it took into consideration, including whether the support amount accorded with the Virginia Child Support Guidelines.(See Va. Code Sec. 20-108.2).

Yes--and no. Parents can contractually agree to custody and support however such would have to be enforced--if necessary--in court. Furthermore, regardless of any agreement between the parents, or any prior court order, the court will always retain jurisdiction to consider a change in custody/support where it is in the best interest of the child to do so.
