Child legal age to choose parent to live with

I have a 9 yr old nephew in custody of his neglectful mother. What age can he go before a judge to ask to be able to go live with his father in North Carolina.

If the child is in VA then the father could immediately file for jurisdiction in VA. The father can file at anytime, regardless of the child's age. Whether a judges decides to hear the child's preference to live with one parent over another is completely within the descretion of the judge.
