take him out of child support

I'm married, but my first child is not my husbands biological child. We want her name change, and the biological father agreed to revoke his rights, and to take him out of child support. Since he is the one that put his own self in in the first placed. I did and waited on the papers he said he was going to sign, he never did. I call him and he stated that was to get him out of child support and that he has again beat the system and that he is not going to let me change her name or get adopted because no judge will hear of that. What should I do.

You need contact a local Attorney for get help.

Child's rights are safe under law always: Child support, etc.

If you want change, you can go to Courthouse with Attorney and request for clarification to him. If he is agree really, you have not a problem.

Make sure that he continues to pay the child support.

FYI, no father can have his parental rights and responsibilities(including his obligation to support) with respect to a given child terminated by simply signing a piece of paper. Only a court of law has such power, and will normally exercise it to terminate a parent's rights only for very compelling reasons, after hearing all of the evidence as to exactly what such reasons might possibly be.
