Legal Question in Family Law in Virginia

Possible Child Support Overpayment

My son's mother has recently been complaining that she does not make a lot of money and feels she pays too much for child support & health insurance. I calculated the % of both of our gross income on the DCSE wesbite. If the website is almost accurate, it appears that her child support payment should be less than now. Can she take me to court to be compensated for this overpayment?

Re: Possible Child Support Overpayment

No. Support may always be amended for a material change of circumstances, but an Order is an Order until it's changed by an Order. If she overpayed, she cannot get it back.

Good luck.
