Legal Question in Family Law in Virginia

Child support question...need help

20 days ago my fiance' was arrested for a charge no one could give us in Lafayette, LA. On the 18th day he was extradited to Wytheville, Va for charges unknown. We come to find out that he was arrested for unpaid child support of $3200 and 2 missed court dates. She told him 3 or 4 years prior that she had taken away all of his rights to his 3 children. Why does he have to pay child support for children he is not allowed to see or talk to? He is allowed no relationship with any of the 3 children. Is there anything he can do?

Re: Child support question...need help

One problem is instead of verifying with the court whether "she had taken away all of his rights to his 3 children"(very unlikely), your finance, apparently, relied on the mother's unverified word, and then, apparently, compounded the problem by deciding on his own to stop paying support----without the court's permission.

Naturally, the court issued warrants for his arrest after following the required procedures.

If your fiance was being denied his visitation rights, the proper course would have been for him to contact the court and, if necessary, have a hearing scheduled to address the matter.

Right now, what he can do is look for a competent attorney to represent him and, hopefully, extricate him from this mess which is mostly of his own making.
