Legal Question in Family Law in Virginia

custody/marital residence

I've lived in the marital residence for over three years now. My ex wants to buy me out. We have court in 2 months for custody. Currently I have primary. He's fighting for primary. If he gets the marital residence will this be bad for my case?

Re: custody/marital residence

No, not necessarily, since your fitness to be primary custodian of the child(ren)is in no way determinately linked to your place of residence as long as such place may be reasonably adjudged to

be reasonably accommodating to the fostering of the best interests of the subject child(ren).

And, no, such place of residence for the children need not be the marital home.
