Legal Question in Family Law in Virginia

divorce @ child custody, one mentally ill parent

My wife is in a mental hospital. She is schizophrenic and shows little improvement. We have a fourteen year old daughter. I don't want her discharged to our home because I fear for our property and our physical and mental well-being. She is delusional, paranoid, hyper-religious, and at times violent. She thinks there is nothing wrong with her or anything she does. When and if she is discharged she won't continue to take her medication. That has been her behavior in the past. How do I keep her out of our home, get custody, and proceed with divorce.

You should obtain counsel who is knowledgeable in Virginia family law matters as well as mental health issues and who can advise you as to how best to proceed.

Your wife should, also, have an attorney to represent her interests and a special guardian may also have to be appointed by the court having proper jurisdiction over these matters.
