Divorce after 2 1/2 years of separation

What is required in Virginia to obtain a divorce after 2 1/2 years of separation with no children in marriage and no legal separation already in force? There is no personal property situation as the house is deeded to me and car is also in my name.

Check with the Circuit Court clerk's office where you live to see if they can provide you with a set of forms for filing for divorce "pro se" (for self, literally, but without attorney, practically.

In Virginia you only need to be separated for a maximum of one year for either party to file for divorce. Given the time you've already separated it does not matter if the other party objects. You are entitled to a divorce immediately as a matter of law.

Divorce in Virginia can be relatively simple and very inexpensive, IF...

If both parties are in agreement, all will go smoothly. If there are any disputed issues, property, support, etcetera, pack a hefty wallet before you see an attorney. Disputed or "contested" issues result in a great deal of attorney time and court costs.

To an attorney calculating his fee, time is money, just as it is with grocers, cab drivers, and professional baseball players. How much money depends entirely on how much time. How much time depends on whether the spouses are fighting over something or just want to get divorced with no fuss and muss.
