Legal Question in Family Law in Virginia

Domestic Assault & Battery

I am going to court against my ex for domestic assault & battery. He has left scratches on my wrists and neck. He has told me that he was ''told'' that the case would be dismissed because of lack of ''true'' evidence. Could he be right or was he just bluffing? Would a judge ''overlook'' this case because it is ''only'' scratches????

Re: Domestic Assault & Battery

No, indeed, a judge presiding over such a matter would not regard scratches on a victim of alleged domestic violence as evidence which might be minimized or disregarded (overlooked) in any respect whatsoever.

Re: Domestic Assault & Battery

I suspect he is simply posturing. Any evidence of an alleged injury will be taken very seriously.
