Ex-spouse is terrorizing new relationship
What are the potential issues involved if a divorced individual is essentially being stalked by an ex-spouse? No physical contact has occured, nor is any anticipated. However, ex-spouse is regularly making unnecessary and constant phone calls, following individual on dates, bursting unexpectedly into home of individual (has key because children are often there, and would have copy made anyway), and all with a general harrassing overtone. Ex-spouse believes that since marriage took place in a Catholic church, they are not divorced, and from this stems the trouble in not accepting the civil action. Add to this formula two minor children of the marriage who individual worries would be adversly affected by any restraining order requested for ex-spouse's behavior. FYI- ex-spouse acting out the ''stalking'' behavior is female.

This is a very difficult situation. I would suggest that you do get a protective order and you can ask that the protective order still provide for visitation with the children. I would also suggest that you allow the visitation to take place in a place other than your home and that you ask the court to grant a facilitator as the go-between for pick up and drop offs. Other than a protective order there really isn't much else you can do.
