Should I file for separation or just wait a year and file for no fault divorce in Virginia.

Technically, in Virginia there is no separation status per se as

it's normally combined in a document with other issues

known as:a Separation and Property Settlement Agreement which

outlines not only how property and assets are to be divided between

the spouses but also may settle other marital

issues such as child support and custody as well as

visitation, and perhaps, alimony.

This type of spousal agreement can be filed with the circuit court anytime

after the initial divorce paperwork has been filed and there

is no need to wait until a year has elapsed.
