Guardianship or Temporary Custody?

My sister has a health issue that is interferring w/taking care of her 6 yr old. She approached my husband and myself about taking custody of her son but she is concerned about terminating her parental rights.

I am concerned about in the cases which she is incapitated and cannot make decisions, we will not be able to speak on behalf of my nephew. Her financial situation is going down hill as well, so we may have to add him to our insurance and I am certain we'll need something other than her word to make that happen.

We need something to cover situations when she is well AND isn't well in the best interest of my nephew as well as something to ease her mind.
