Legal Question in Family Law in Virginia

My husband currently has joint custody of his son. The mother would like to move out of state for a year and have the son live with us. There is no animosity and they are hoping to come up with an agreement with as little disruption as possible. Do they need to retain lawyers and return to court or is there some kind of mediation they can go to and get the custody agreement updated?

Your son can file a motion to amend the custody order; and he and the mother can request mediation. This should be offered at no cost, and the mediator will assist in drafting up the amendment and delivering to the Court for the entry of an agreed order. Either parent is, of course, entitled to have an attorney in the process, but if they are both in agreement, they may decide it will not be necessary initially.
