Legal Question in Family Law in Virginia

My husband (we have been seperated for 5 years) informed me that we were not legally married because he gave an incorrect name, His was emmett kenneth and he gave kenneth emmet also gave false SS# and other info. I wanted to know if this is true, if so I am going to have my name back to maiden name. We were married in Whyte County Virginia. I live in another state from him but I wanted to know if I needed to do anything legally if we were never married I won't have to file for divorce.

From a legal perspective, you would be safest (in my opinion) to consider yourself to have been validly married under the facts described, and, therefore, in order to properly dissolve that marriage, required to go through the divorce process.
