If someone is legally sperated from their husband, and their husband had a severe stroke and is no longer able to speak for themselves, can the person with power of attourney file for divorce on behalf of the incapacitated person?

It is likely in such circumstances that the Court would require a guardian ad litem be appointed to represent the interests of the incapacitated person.
