Legal Question in Family Law in Virginia

I live in Virginia and the father of my child lives in South Carolina and has never seen his 2 year old daughter. He is not currently on the birth certificate and I am seeking child support. A paternity test has already proven it is his child. I do not want him to have any rights to her if something happens to me, therefore do not want him on the certificate. Do I have to put him on the birth certificate to recieve any benefits?

Paternity of the subject child needs to be legally established in the form of

a proper court order before any court will order that the father pay child support.

From the facts which you've recounted in your question thus far, it would appear that that has yet to occur.
