Legal Question in Family Law in Virginia

HELP. Please point me in the right direction!

I with my newborn 3 yrs ago so my

[now] ex could finish his undergrad

and we could all still be together.Less

than a year later he informs me he is

moving in 2months. My ex moved 9

hrs away almost 2 years ago leaving

me and his daughter behind, being

asked not to come. Since then i

have moved on and have plans to

move back to my home state

5/2009. He visits for 24-48hrs a

month. His father pays me monthly

for 'child support' [a substantial amt],

he pays nothing. He has never spent

24 hrs alone with her, let a lone an

overnight stay. When he visits he

stays at his parents house and they

refuse to leave him with her due to

knowing his lack of common sense

would affect his ability to watch her

24/7 as a parent should. I just

received last week a summons for

joint custody. Same week he

received a custody agreement that i

had written up. He filed his with the

state of VA [i did not], but he resides

elsewhere [legal info has his home

state address]. What should my next

step be? i have no intentions on

trying to stop his opened ended

visitation/visitation schedule. i dont

believe he should have any other say

in her life.Not w/ only 2 days of

contact a month.

Your next step should be to retain the services of an attorney to represent you in this pending custody matter. And, if you cannot afford to hire such on your own, then check with one of the low cost legal services providers in your area to see whether you might qualify for one to assist you in this matter.
