pregnant serving time
if you are pregnant and arrested and charged with a crime in virginia. But you are legally married , and the baby is not your husbands. What happens to the child while you are in prison? Who actually gets custody of the baby?

Most likely the person to whom you're currently married, i.e., your husband.
