Legal Question in Family Law in Virginia

On preparing a PSA, my wife and I agreed that our 8 year old son will continue to stay with his mother overseas most of the year and that I will see him for a few weeks during the summer and winter break. I'm having difficulty with writing a clause that describes :

We both agree that whichever party has physical custody of our child, that party will be responsible for the child's support, maintenance and education.

The child's mother is from a very wealthy family so she waived spousal support and states that she does not need my financial help in raising him, only my emotional support and time for him. Can anyone help me write this cleanly?

You would be well advised to retain the services of a

Virginia attorney who handles divorce matters to assist you with this particular issue as well as with finalizing the Property Settlement Agreement prior to its filing with the court.

It is quite unlikely that any attorney in this forum would be willing to

propose appropriate language for the issues you've described without

having reviewed the entire PSA document beforehand and the relevant facts related to its execution.
