Relocating

My ex husband has full custody of our two children, I have visitation but no legal custody. What can I do if anything if he wants to move to a diffrent state for work purposes? He is planning ot move from Virginia to Texas for a new job and I want to know if there is anything I can do.

Virginia law requires that any party changing thier address give the other party and the court thirty days notice before they make such a move. This gives the other party time to file a motion to amend the prior order to ask the court to review how the relationships should proceed after the move.

This is a difficult issue between parents and children and the move must be in the best interest of the child. The Court should appoint a Guardian for the child and you should hire an experienced attorney.

By Virginia law, he has to give you 30 days notice of his plans to relocate. That gives you time to file an objection with the court here in Virginia.
