Legal Question in Family Law in Virginia

Sale of Marital Home

I am recently divorced. Our marital home has been appraised at $365,000. I had it listed $310,000, recently agreed to reduce the price to $290,000 to help sell. Received an offer at $277,000, my wife is trying to force me to take the offer. Can I be forced to sell my home for less than it is worth ?

Re: Sale of Marital Home

I have no idea why anyone would choose to remain co-owners of a home with their divorced spouse. Nevertheless I hope you made provisions for the sale in the divorce decree or a property settlement agreement. If there are deadlines, then you must sell for the highest price you can get within that time. I suppose if there is no deadline you can refuse to cooperate until the market changes. You know there are many reasons why houses don't sell for top dollar. When it is time to sell a house, the "best price" is the most you can get for it.

Good luck.

How could you be forced to sell absent a valid order from a court having proper jurisdiction over the matter?
