Legal Question in Family Law in Virginia

Seperation agrreerment

I have a divorce agreement in place (notorized but not filed w/anyone). The agreement stated my husband would move out & finish certain things (w/in 3 mths of moving which should have been 6/30 in exchange for a specific $ amt. He moved out after I gave him 3/4 of the initial amt owed, but still has not finished what he agreed to. I have kept his belongings in my garage, house & shed for almost 3 months w/out receiving compensation from him. Additionally, he still has not done what he agreed to. What are my rights? I broke part of the agreement by allowing someone else to watch my dogs while I was on a trip & somehow one of my dogs was attacked & killed (we think by this other persons dogs) while this person was living in my house watching my dogs. Also, I w/held approx. an add'l. $5K from my husband until all his belongings were off my premises. I agreed I would pay him everything I owed him (including an add'l. $12K I held back until final completion of the garage & removal of everything agreed to in the agreement). I know I agreed to give him way more money than the house was worth & now I don't know what my rights are. I have been trying to be agreeable to things so he wouldn't argue about signing the Quitclaim Deed.

Re: Seperation agrreerment

The answer depends on what your agreement specifies. Was he supposed to finish the work, BEFORE or AFTER you paid him in full? When was he supposed to sign the Quit Claim deed according to the agreement?

You should hire an attorney to look at your agreement to determine how the terms affect your rights. Since it is a contractual issue, it all depends on the terms of your contract.
