Sole Custody

I am the custodial father of our 10-year old with the mother having visitations on Mon./Thurs. after school and weekends. My son is undergoing sever mental/emotional abuse from the mother. She has commented to him on signing a piece of paper so he never sees him again & told her mom last night she might as well give up her parental rights. All she does is fight & argue with him, talk negatively about me and my wife, and has her mother watch him on her visitations while she goes out to the clubs. My son's school counselor, school assistant principal, and licensed counselor of 3 years is telling me she is affecting him severely & I need to get him away from her. I have just found out that he doesn't even want to see her anymore. Since she is making comments of giving up her parental rights to him, how do I go about that in the court of law?

You could petition the court to bar all visitation of your son with his mother, but such court is unlikely to terminate the mother's parental rights based upon the circumstances which you've described (in my opinion).
