Legal Question in Family Law in Virginia

My son wants to change his last name to his step fathers and my last name now that were married. His real father is refusing to allow it. When can he change it legally without his fathers permission?

Well, he can always ask the Circuit Court in your area to order a name change. This is realtively easy if everyone agrees, or if he is an adult. If his father does not agree, then there will have to be a hearing and the judge will decide. It is still possible. But it will be much more time-consuming, involved, and more costly in terms of an attorney's time if there is a dispute about it. The Court might say yes or no.
