Legal Question in Family Law in Virginia

Termination of Child Support

I want to have documentation drawn up stating that the non-custodial parent give me full custody (currently I have joint/physical) and open visitation will be given to the non-custodial parent as long as it's reasonable and I agree to the time/date requested. In return I will request all child support obligations including arrearages be dismissed and/or terminated (currently support is handled by DCSE). If both parties agree to the terms and this is presented to a judge will he/she be willing to sign off on this request or can the judge deny it for whatever reason? Does DCSE have to agree to the terms as well or is it my decision/right to terminate child support?

Re: Termination of Child Support

Good morning,

Yes, the court will sign off on your joint request to change the custody and support provision and DCSE will not challenge your agreement. This is a rather simple matter to handle. Let me know if you need any further assistance.
