Legal Question in Family Law in Virginia

Violation of visitation rights of non-custodial parent

I have visitation with my daughter every other wkend. LAst month I did not visit because of work and I went out of town at which grandmother was notified. She is the go between for picking the child up at her house. The father all of a sudden does not want to do visitation and the grandmother states she didn't want to get involved.

However, she has been the person that I make arrangements with on picking the child up at her house; per the order of court set on June 13, 2005. I spoke with law enforcement and they stated as long as I had the order with me thye would go and get the child. THere is no other order at the court for visitation and I told them that I had to be summoned to court in order for him to change the order. The father is NOT THE JUDGE! No one can change the judges order except another judge! What do you suggest?

Re: Violation of visitation rights of non-custodial parent

I'd file a Motion to Show Cause and get the Judge to enforce the order against the father. If he continues to disobey the order the judge can sanction him appropriately. Good luck!
