Legal Question in Family Law in Virginia

Ex wife stalking?

I live in the same neighborhood as my ex-wife, until recently it hasn't been much of a problem. Lately she's started biking, running, or taking a walk by my house almost every day. When I questioned her about it, she told me it's ''part of my 3 mile loop for running''. We have 2 children and have joint custody. Last night we are eating dinner and my son sees her run by and jumps up from the table and runs out the door to say Hi to her. It's becoming disruptive to our lives, can this be considered stalking?

Re: Ex wife stalking?

No, this is not stalking. Stalking must consist of two or more acts that place you in reasonable fear of criminal sexual assault, bodily harm or death. Her running by your house would not constitute a criminal act as you have described it.

Re: Ex wife stalking?

No... not from the details that you shared. Are you in danger, are your children in danger? Have there been threats of sexual nature? In some extreme circumstances it may possible be harassment... but honestly from the scenario that you described it hardly even looks suspicious.

Sincerely,
