Legal Question in Medical Leave in Virginia

Discrimination?? Retaliation??

I am Va. State Employee. I have requested days off and have been denied with the reason of short staffed. I have never requested anytime off prior to this. My other co-workers have been given days off that were longer than the time I requested. I was told today that since I am having surgery in December that any weekend days I miss because of it I will have to make up which I have never even heard of before. The reason given is she considers it '' calling in''. There are other co-workers who have had surgeries and this was not done to them. I have a excellent attendance record, good evaluations and no written or verbal reprimands. I have worked for state agencies over over 6 years and have 2 major surgeries and have never had to make up days as long as I had leave time. I feel that I am being retaliated against because I went to Human Resources and complained about a co-worker who has horrific body odor and though all staff have complained nothing has be resolved. What can I do?

You may need to exercise your right to challenge this decison by filing a grievance through the state employees' grievance process (if higher management refuses to do anything about it).
