Legal Question in Medical Leave in Virginia

I was told that I only have a little more time allowed on my intermittent FMLA, I have serious health problems and I have to miss in average maybe 2 or 3 days per month. how do they figure this time?

FMLA leave is 12 weeks of unpaid leave during the 12 month period in which the

employee is eligible to take such leave. Whether this leave is taken intermittently or consecutively, it's no more than 12 weeks during the referenced period of eligibility.
