Legal Question in Civil Litigation in Virginia

My 16 yr old son was involved a car accident the other persons medical bills exceed my insurance amounts now he is suing parents. We don't have any assets other than the house we live in and my husband truck and my truck what do they go after? do they take whatever you have in the bank or if we have a CD for our kids college?

Assuming your son was a licensed driver and not on an errand for you or your husband, and you had no reason to believe he was an unfit driver before he had the accident, you, as parents are not liable for his negligence. I am also assuming that the accident was in Va. and there were no "unusual circumstances". Generally speaking, without some special circumstance, parents in Va. are not liable for the negligence of their children.
