Legal Question in Civil Litigation in Virginia

assault civil suit

I work security at a bar and was assaulted from behind. My jaw was broken and I also had a laceration to my upper lip that required 5 stitches. Workers comp is paying for most of my medical needs, however I was wondering if I should wait until he is convicted to sue him, and also what kind of ruling I should receive. My jaw is wired shut for 8 weeks so I am missing out on some pay from work and I have special needs when it comes to food and everyday life now.

your workers comp should be paying medicals and wages. As for suit against the wrongdoer, timing isnt really the issue. A plea of guilty will help in the civil suit, but a finding of guilty with a plea of not guilty cannot be used in the civil suit. The question will be what assets does the wrongdoer have...it is highly unlikely that he will have insurance to cover this--but maybe.
