Legal Question in Civil Litigation in Virginia

I entered a contract where the other party agreed to pay me 50000 dollars within 90 day in exchange for me not suing him for an earlier incident. 90 days.have past and I havent received anything. Can I sue for breach of contract and still go after him for the earlier incident? Or would going after him for the earlier incident take away my right to sue him for breach of contract?

would be necessary in order to ascertain with greater certainty as to whether all of the elements were present in your contract to ensure its enforceability. (And, if in fact you never had a written contract, then all bets would be off, so to speak, as to whether you could do anything with it all in terms of enforcement(in my opinion).
