Legal Question in Civil Litigation in Virginia

Joint assets

I am being sued for 17K. I do not disagree. When I go to court I want to work out a playment plan. However, I am on several joint accounts with my elderly mother; I do not want those accounts to be looked at as my ''assets''. they are not; they are there in case of a family emergency. Can the court order me to pay using those monies?

Re: Joint assets

The court can enter a judgment against you but will not instruct you as to how to pay it. Your judgment creditor may well determine how that may happen if he or she succeeds in obtaining such against you. And, if your name is on joint accounts with assets that can be seized to pay the judgment, the creditor may well choose to levy against those accounts in order to satisfy the judgment.
