Legal Question in Civil Litigation in Virginia

Last month I put a deposit on a van. I the seller and the buyer verbally agreed that I will return on the 13th of November to pay the balance in full. Before the 13th arrived I discovered that I wasn't able to come up with the balance. Now, when I put the deposit down the seller wrote a contract stating that she sold me a 1999 van for 2,000. Also, since that time the seller and her husband was involved in a head on crash which had them hospitalized 2 weeks before our verbal agreement date. So when I went over to her house her son said that I couldn't get my deposit back because its been longer than 30 days. Now, I want to file a civil claim either for my deposit or for the van since the contract the seller wrote that "I sold (my name) a 1999 van for 2,000). I signed and she signed.
