Legal Question in Civil Litigation in Virginia

do i owe this man any money?
went to buy a used car,i told the salesman that i had to have my son look at the car before i could make a decision. he said that was fine, just give him a check to hold it. if i bought it he would put it towards the down payment, if not i got the check back. he told me to wrute deposit on it. my son looked at the car but did not like it. i told him and asked for my check back. he told me i wasn't getting the check it was a down payment on the car. i put a stop payment on the check, now he is taking me to court to try and get the money. what can i do?

If you're required to go to court, just repeat to the judge what you've stated here and this predator's case should be dismissed (with prejudice).
