Legal Question in Civil Litigation in Virginia

I recently took a trip to Virginia and i used an atm from a different bank then mine at home. I procceeded to make a transaction of 300.00. Then atm machine shut down at the end of the transaction and it took my atm card. I was upset and the bank person apologized and said the machines go down sometimes. I went across the street to another atm and went to check my balance and there was 300.00 missing, I was highly upset and went into the bank and they told me the proper proceedure to go threw to retrive my money, I filled dispute iwth my bank and a few days later the dispute was denied by this bank. It is yet to be seen why it was disputed i did not get the money and i am very unhappy with this whole situation. I want to no if there is anyhting i can do legally?

Yes, you could sue the bank in small claims court that improperly confiscated your $300 for that amount + costs.
