Legal Question in Civil Litigation in Virginia

Recovery of Legal Fees

I am involved in a civil case where my roommate and I were sued by my roommate's mother. The claim was fraud but my roommate's mother dropped the case against me because only my roommate signed a promissory note and there was no proof of fraud against me - only my roommate. Is there any way for me to recover my legal expenses from my roommate's mother because obviously if the case was dropped it never should have been filed to begin with.

Re: Recovery of Legal Fees

No, your conclusion amounts to a legal nonsequitur, meaning that merely if a case is filed in court that that necessarily means that "it never should

have been filed to begin with."

You're dead wrong in this conclusion, and, therefore, you can forget about recovering whatever legal expenses you may have expended in this matter.
