Legal Question in Civil Litigation in Virginia

setting aside default judgment pt 7

Once again, I would like to thank everyone who has responded to my questions, your answers have been helpful.

I have since filed a petition with the circuit court requesting that the judgment mentioned previously be vacated; with process of service through the sheriff's department and no response from the other party with the time exceeding 21 days. I have also filed a motion with the same court requesting that same act. my question now is: Can I file more than one motion to be heard at the same time? And if so, should I also file a motion to dismiss?

Re: setting aside default judgment pt 7

Yes, you can file multiple motions regarding a single pending matter, but it will be up to the court to determine which(if any) should be acted upon and either granted or denied.
