My sister's family dog was shot and killed with a shotgun today by animal control. He had gotten out of his pen. He was well within his yard. They said he was 'aggressive,' but he has never bitten or hurt anyone. Does she have case to sue the city?

She could but it will be difficult. If she is going to pursue this, your sister needs to see an attorney asap. Your query does not mention why the dog was considered to be aggressive or whether there were any witnesses.
