Re: applying for citizenship

The immigration consequences of a DUI conviction depend on the state law and the relevant circuit court precedent. USCIS may consider any criminal conviction in making a determination regarding good moral character for purposes of an application for naturalization. Even if a conviction does not fall within one of the statutory bars to a finding of good moral character, it can still be a basis for a finding that the applicant lacks good moral character and the denial of his or her citizenship application. In your situation, it seems that you could prove you have had good moral character for the last five years and that you have rehabilitated, as you have not had an offense since 2000, however, you should consult with an immigration attorney before filing your application so he/she can review the docket sheets and court disposition documents regarding your criminal cases in order to better assess any possible consequences to your immigration status.
