Legal Question in Insurance Law in Virginia

Blazer slid into my van.

On an icy hill, a man slid into my van that was off the road. He finally got his blazer up the hill, walked back down and gave me his business card. Nither one of us had pen or paper on us. This happened 4 weeks ago today. He refuses to give us the name of his insurance company, and will not cooperate with us. We finally had to turn it into our insurance company and they are going to fix my van. A man from our insurance company called me yesterday and I had to give him a statement as to what happened. After I gave my statement, he said he talked to the other party earlier and is adament that he did not do any damage, because there wasn't any damage to his vehicle which just happend to be the school boards vehicle. After I gave my statement, I was told, that because we didn't call the police, I probably can't get his insurance company to pay for the damages. Is this true. And if we end up having to get a lawyer for this, can he be made to pay for it??????..............Thanks..........Diane

Yes, it's probably true that his insurance company won't pay because he denies that he caused the damage and there's no independent(police) report to corroborate your claim.

However, you can sue this miscreant in general district court for the damages and recover a

judgment which his insurance company will be obligated to pay. They will send one of their lawyers to defend the case, so you very definiely should have one to represent your interests.
