Legal Question in Employment Law in Virginia

My employer requires us to be onsite at 6:45am, take our break from 9:00 until 9:15, and lunch from 12:00 until 12:30pm. The total amount of hours worked is 8.25 hours; however, they only paid all employees for a 8-hour working day. According to Virginia DOLI Field Operations Handbook Chapter 31 - Hours Worked, Article 31a01(a) the break should be counted as hours worked. Do I have a legitamite claim for back wages?

Probably, not, but you could always send a complaint to the DOLI with

a request that they investigate.(However, you might want to hold off on that at least until you have another job lined up.)
