If a lease was never signed, but a tenant occupies the residence, what rights does the landlord have in getting the tenant to vacate the property?

File a warrant for unlawful detainer against this "tenant" in the

local general district court, asking for a judgment for all back rents that

could be lawfully owed along with a writ of possession for the premises.
