Legal Question in Landlord & Tenant Law in Virginia

I have been living in an apartment for over four months now and the leasing office has over and over again promised to add my girlfriend to the lease and that it is no problem that she stays with me. She has stayed long over the 30-month visitation limit as well as our son. I'm finding this sort of ridiculous as the original promised date was 'within two weeks' of my signing the lease and now every time I pay rent and ask about it they assure me it'll be done soon.

Can I take any action to get out of this lease?

No, not until this lease nears its natural expiration date, whereupon

you should have the option of notifying the landlord and/or its agent (within the required time period) of your intent not to renew this lease.

The facts that you've presented in your question as justification under Virginia

law to excuse your premature departure from your rental premises without

penalty would not suffice (in my opinion).
