Legal Question in Medical Malpractice in Virginia

Abdominoplasty malpractice/lack of care

After having an abdominoplasty on July 31, 2007, I started having excruciating pain at 2 wks. post-op. Upon advising my PS and going in to see him, he said it was probably due to constipation. He changed my pain meds but the pain did not get any better. This pain continued to get worse and I started swelling and developed a bulge in my abdomen. My PS never physically examined me when I went to see him on several occasions and then cut out all pain meds. He ended up telling me he had no idea what my problem was and couldn't help me. I ended up seeing 5 other Dr's and going through different types of testing. No other PS's in the state of VA would see me so I ended up having to go out of state to a new PS. Within 10 min. she knew exactly what was wrong and what I had thought all along. The muscle repair from the TT (tummy tuck) had ripped and there was herniation. I had to have it re-done. My original PS, upon my original consult. told me he was going to use permanent sutures and then I found out, on my last visit to him, that he used dissolvable sutures. This is probably why the tissue ripped. Do I have a case to sue him due to the fact that he was negligent in his lack of aftercare and totally dropping the ball?
